The Willcox AMA Grandfathered Rights Deadline Has Passed. Here Is What Still Has to Be Documented.

Applications closed 8 April 2026. But annual withdrawal reporting, measuring devices and the cap on legally irrigated acreage are permanent obligations — and proving what you irrigated is now an evidence problem rather than a paperwork one.

If you farm in the Sulphur Springs Valley you already know the dates. The Willcox Active Management Area was designated in January 2025, and the window to apply for a certificate of grandfathered right closed on 8 April 2026, with no extension.

That deadline is gone. What is not gone is everything that follows it — and a good deal of it turns on being able to demonstrate what you actually irrigated, and when.

What the AMA actually locked in

Three obligations survive the application deadline and are permanent features of farming here now.

Irrigation is capped to acres legally irrigated in the five years before 23 October 2024. Not the acres you could irrigate, not the acres you have water for — the acres you demonstrably did irrigate in that window. New irrigation acreage is prohibited without a grandfathered right.

Measuring devices were required on non-exempt wells — those above 35 gallons per minute — by 31 March 2025.

Annual withdrawal reports are due 31 March each year. Every year, indefinitely.

The domestic well exemption is unchanged

A well with a pump capacity of 35 GPM or less used for non-irrigation purposes remains exempt inside an AMA. No groundwater right, no permit, no meter, no annual report. If you are a homeowner rather than an irrigator, most of this article does not apply to you.

Why documentation became the issue

The scale of the problem is worth stating, because it explains why the state acted and why the enforcement posture is likely to tighten rather than relax.

ADWR's own figures for this basin: annual overdraft above 100,000 acre-feet. Groundwater levels down as much as 400 feet between the 1940s and 2015. 71 wells gone dry in a decade. More than 11 feet of land subsidence, at a rate that accelerated from 1.2 inches a year in 1996 to 2.8 inches a year in 2023. More than 50 miles of earth fissures. And an estimate that if all pumping stopped today, recovery would take over 280 years.

Against that, the 2022 Census of Agriculture counted 108,237 irrigated acres in Cochise County across 1,002 farms averaging 1,034 acres each, with the market value of products sold at $340.5 million — up 135% since 2017.

A regulator with those numbers and that trend is not going to take acreage claims on trust indefinitely.

Where aerial documentation fits

Be clear about what this is and is not. An aerial map is evidence, not a legal determination. It does not establish a right. What it does is produce a dated, georeferenced, measurable record of what was under irrigation on a given day — which is the kind of thing that is very useful to have and impossible to reconstruct after the fact.

Concretely, what a flight produces:

  • An orthomosaic — a flat, scaled, measurable map of the operation rather than a perspective photograph. Acreage can be computed from it directly.
  • Georeferenced field boundaries, so an irrigated block is defined by coordinates rather than by description.
  • Vegetation and vigour mapping, which distinguishes actively irrigated ground from fallow or dryland at a glance and in a way a photograph does not.
  • Infrastructure documentation — pivot positions and wheel tracks, drip lines, wellheads, meters, tanks, laterals.
  • A date and a coordinate on every frame. That is the part that makes it evidence rather than a picture.

Building a record going forward

The useful version of this is not one flight. It is the same flight, flown the same way, at the same points in the season, year over year.

A sensible cadence for an irrigated operation:

  1. Pre-season, before green-up, establishing the baseline and the state of infrastructure.
  2. Mid-season at peak, when the difference between irrigated and non-irrigated ground is at its most obvious.
  3. Post-harvest, closing the year's record.

Three flights a year, held in a dated archive, gives you something considerably better than a memory and a shapefile when a question arises in 2031. And because it is the same flight each time, it doubles as an agronomic record — you can see year-over-year change in the same blocks, which is genuinely useful independent of any regulatory question.

Two honest limitations

Aerial imagery captured in 2026 says nothing about 2021. If the question is what you irrigated in the five years before October 2024, the evidence you need is historical — satellite archives, USDA NAIP imagery, your own records, pump logs, crop insurance filings. We cannot fly the past. What we can do is make sure the same gap does not exist five years from now.

And second: we are currently flying RGB imagery, which produces vigour indices rather than true NDVI. NDVI requires a near-infrared sensor, we do not currently have one, and we would rather say so than let the acronym do work it has not earned. A multispectral sensor is in the plan; when it lands, we will say so plainly.

What this costs

Agricultural work is priced per block at the small end, because per-acre pricing falls apart on anything under about forty acres — at a few dollars an acre the drive costs more than the job.

Minimum call-out is $375 and covers up to 40 acres. Above that it runs $8 an acre to 160 acres, $5 to 500, and $3 beyond. A season subscription of six scans carries a 25% reduction billed monthly across the growing season, and if we can cluster two or three operations into one loop through the valley, that comes down again to $295 each.
